A lawsuit against Disney cruise line: Disney Cruise lines sued with the allegations of toddler’s sexual assault

A Vermont couple filed a Lawsuit against Disney cruise line for $20 million for not giving proper training to its employees on how to take care of minors in a daycare.

Parents alleged that the employees at the cruise failed to intervene and recognize when their three-year-old daughter experienced sexual assault by another child at the Disney cruise line, in January 2020.

Jane Doe & John the anonymous couple claim that the workers at the Fantasy cruise line daycare failed to identify the possible outcomes of keeping the children of 3-12 years together at a place.

They claim that even if the employees at the cruise know that their 3y/o daughter – R.V. was sexually assaulted, they did not inform them. They also mentioned that the daycare employees are neither licensed nor trained to work with small children.

Cynthia Martinez, the spokesperson from Disney cruise line denies the claim with the statement;

The plaintiffs’ first allegations were reported to the FBI, and the Brevard County Sheriff’s Office investigated them and determined them to be unfounded.”

He added,

 “The plaintiffs have now come back with a different story, which is equally unfounded, that another young female child acted inappropriately with their child. We will vigorously defend this case in court.”

According to the case filed on Sept 22 in the US District Court in Orlando Division, the reported couple sailed on the Disney Fantasy cruise from January 4-11 and left R.V. at the Oceaneer Club aboard the ship.

However, Disney described the place as a ‘kid’s activity center’ where children can play, craft, and enjoy the media of the room.

R.V was enjoying the music in the Club’s Media lounge on Jan 9, 2020, when R.V was “physically restrained and sexually assaulted by a significantly older child,” according to the court’s reports.

The Lawsuit against Disney cruise line does not show how the parents identified the assault. The attorney representing the family said that RV a trained child for her needs, having panic attacks after the assault –reenacts the assault as what happened.

“It’s easy to say this is a parent’s worst nightmare,” RV’s father said. “They went on a Disney cruise, they put their child in, basically, the daycare of Disney. This is about the last thing that they would ever imagine would happen.”

Through the lawsuit, the family is trying to spread awareness against the prevalence of rape and sexual assault on cruise ships.

Winkleman said, “In their eyes if they can raise awareness about it and prevent this from happening to even one other child, that’s a huge victory. ”
